



Applicability
(1) All orders, commissions accepted and rendered services by Louise J Scott BSc (hereinafter “the Artist”), take place exclusively on the basis of these Terms and Conditions. These are part of all agreements concerning commissions and services by the Artist with the buyer. The Terms and Conditions apply for all future business relations between the buyer and the Artist.
Copyright
(1) All copyright, trade marks, design rights and other intellectual property rights (registered and unregistered) in and on www.artistlouise.com and all content located on the site shall remain the sole property of the Artist.
(2) All artwork is protected by Copyright ©. The Artist is the sole owner of this copyright, the purchase of a painting or any other piece of art in no manner gives the buyer any claim to the Artist’s copyright or reproduction right.
(2) Your portrait must not be copied without written permission from the Artist.
(3) No copyright information will appear on the final portrait.
(4) It is the responsibility of the person who commissions the Artist to obtain permission to use photographs for creative reproduction.
Orders and conclusion of agreement
(1) Orders do not become binding until they have been accepted. The Artist is free to refuse any orders without further explanation.
(2) Commissions will only be accepted, and will only commence on receipt of a non-

(4) You can arrange for the Artist to visit you to photograph your horse, dog or cat. The photography and time are a free service. A return mileage cost to your home is payable at the time of the visit and will be agreed upon on a case to case basis.
Payment and Prices
(1) The prices are in Pounds for unframed artwork and are exclusive of the costs of packaging. Also exclusive of statutory value added tax and custom charges outside the UK..
(2) Extra required services or special requests concerning issues like transport and extra insurance can be organised at request and expense of the client.
(3) Gift tokens are only available in pounds sterling and will have a validity of two year from the date of issue.
(4) Invoices are due within 30 days, decisive for the due date of the invoice is the date on which the Artist receives payment. Cheques are valid as payment once they have been successfully cashed.
(5) If the buyer does not fulfil the invoice by its due date the buyer will without further warning be considered in default, and the arrears will be calculated at the due date.
(6) If the Artist sends a reminder the costs of this reminder will be at the buyer’s expense.
(7) The Artist may refuse delivery until payment has been made.
(8) If after a reasonable period for fulfilment set by the Artist the buyer has not paid, the Artist may rescind from the contract and will be eligible for compensation of the value of the damages caused to the Artist.
Delivery
(1) Deadlines are always only approximations. The Artist will endeavour to meet the agreed completion time but disclaims liability for any expenses or personal injury suffered as a result of a failure to deliver on time.
(2) To the extent that delivery has been agreed upon the deadlines and terms refer to the time of handover to the carrier, or other party commissioned with the transportation.
(3) The Artist will not assume liability in cases in which performance is impossible or delayed due to an act of God or other unforeseen events at the time of execution of the contract. (4) Liability passes over to the buyer no later then with the handing over of the artwork to carriers, or other parties entrusted with the execution of the delivery to the buyer of the artwork.
Personal details
(1) The Artist protects the security of the buyer’s personal information.
(2) The Artist has the right to use stories and feedback for marketing purposes especially but not limited for use on the web site.
Other
(1) If you are not happy with your portrait, the Artist will undertake reasonable requests for changes. Postage will be charged any additional costs will be agreed upon on a case to case basis.
(2) No responsibility is accepted by or on behalf of the Artist for any errors, omissions or inaccurate content on the web site.
(3)To the extent that these General Terms & Conditions have any unintended omissions these are to be filled in by the contracting parties taking into account what the parties would have agreed upon if they had been aware of the omission as well as taking into account the commercial goals of the existing contract(s) between them. This also applies in the event that any of the existing clauses is declared to be invalid before a court of law.
(4) These terms shall be governed by and interpreted in accordance with the laws of England and Wales which shall have exclusive jurisdiction over any disputes.
